We posted recently about the controversy surrounding the construction and financing of the Downtown and Midtown tunnels in Hampton Roads. In particular, there has been much dispute about charging tolls as a method of paying for those projects. On Wednesday of this week, a Portsmouth Circuit Court judge ruled that using the tolls to finance the project was unconstitutional. The Norfolk newspaper reports that the Commonwealth of Virginia could be on the hook for the balance of the cost for the project if the tolls are not allowed. Stay tuned, as the Commonwealth says it will appeal the circuit court’s ruling to the Supreme Court of Virginia.
